These Terms of Service ("Terms") govern your access to and use of mixedmetrics.com and the MixedMetrics platform ("MixedMetrics", "we", "us"). By accessing or using the website or service, you agree to these Terms. If you do not agree, do not use the service.
Acceptance of terms
By creating an account, accessing the website, or using the service, you confirm that you have read, understood and agree to be bound by these Terms and our Privacy Policy. If you use the service on behalf of a company, agency or client, you represent that you have authority to bind that organization to these Terms.
What MixedMetrics is
MixedMetrics is a cross-channel marketing and revenue analytics dashboard. With your authorization, our read-only connectors pull aggregated metrics from your ad platforms, store, billing, and email and CRM tools, then blend them into one live view of blended ROAS, CAC, MER, LTV, and revenue by channel, with an AI layer that surfaces what changed and where money may be leaking. MixedMetrics is a reporting and analytics tool. It does not run your campaigns, change your tools, or move money on your behalf.
Read-only connectors
You are responsible for authorizing the connectors you choose to link and for your accounts on those platforms. Our connectors are read-only and request the narrowest scopes needed to read the metrics that power your dashboard. We never write to your connected tools, change your campaigns, or move funds. You may disconnect any connector at any time, which stops further reads from that platform. You must have the right to connect each platform and to share the data you make available to us through it.
Eligibility and accounts
You must be at least 18 years old and able to form a binding contract to use MixedMetrics. You are responsible for the accuracy of the information you provide, for keeping your account credentials secure, and for the activity that occurs under your account. We may suspend or terminate accounts that provide false information or that we cannot reasonably verify.
Your data and ownership
The aggregated metrics read through your connectors, and the dashboards and reports you build, belong to you. You grant us the limited rights needed to read, process, store, and display that data to operate the service for you, including computing blended metrics and generating insights. We do not sell your data and do not use your business metrics to train models for other customers. You can export your data and disconnect connectors at any time.
Not financial advice
MixedMetrics presents your marketing and revenue metrics and surfaces patterns in your data. It does not provide financial, investment, accounting, or tax advice, and any insight, alert, or recommendation it surfaces is informational only. You are responsible for decisions about your spend, budgets, and business. Metrics may contain gaps or errors originating in the connected platforms, and you should validate figures before acting on them.
Acceptable use
You agree not to use the service to: connect platforms or data you do not have the right to access; upload or process unlawful or infringing material; attempt to gain unauthorized access to the service, other accounts, or connected systems; reverse engineer, scrape, or resell the service except as permitted by law; interfere with the integrity or performance of the service; or use the service to violate applicable privacy, advertising, or consumer-protection laws. We may suspend or terminate accounts that violate these Terms or applicable law.
Fees and payment
MixedMetrics is a paid subscription service and does not offer a free plan. Fees are billed in US dollars on a recurring subscription basis. Plan details, billing cycles and prices are described at the time of purchase. Unless stated otherwise, fees are non-refundable except as required by law. We may change pricing on a going-forward basis with reasonable notice.
Service availability
We work to keep the service reliable, but availability may depend on the connected platforms and their APIs, which can change, rate-limit, or interrupt access outside our control. We may modify, suspend, or discontinue features with reasonable notice where practical.
Disclaimers
The service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted or error-free, that connected platform data will be complete or accurate, or that any metric, insight, or report will produce a particular business result.
Limitation of liability
To the maximum extent permitted by law, MixedMetrics and its suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or related to your use of the service or any decision made based on its output. Our total liability for any claim relating to the service will not exceed the amount you paid to us for the service in the twelve months before the event giving rise to the claim.
Indemnification
You agree to indemnify and hold harmless MixedMetrics from any claims, damages or expenses arising out of your use of the service, the data and platforms you connect, or your breach of these Terms or applicable law.
Termination
You may stop using the service at any time and disconnect your connectors. We may suspend or terminate access if you breach these Terms or use the service unlawfully. On termination, your right to use the service ends, and you may export your data before your account is closed, subject to reasonable notice.
Governing law
These Terms are governed by the laws of the jurisdiction in which MixedMetrics operates, without regard to conflict-of-law principles. The specific governing jurisdiction is set out at the time of purchase or by written agreement.
Changes to these terms
These Terms, together with our Privacy Policy, are the entire agreement between you and MixedMetrics regarding the service. We may update these Terms from time to time. When we make material changes, we will update the date above and, where appropriate, notify you. Your continued use of the service after an update means you accept the revised Terms.
